POLICY AND TERMS FOR DEALER/JOBBER/INSTALLER PROGRAMS

GENERAL INFORMATION

HOURS OF OPERATION:
Sales and Technical support staff are available from 8:00AM to 5:00PM(EST), Monday through Friday. Power By The Hour Performance is closed Saturday, Sunday, and most legal holidays. General information is available by calling 561-737-2331 or email [email protected].

SALES INFORMATION

Direct Sales will be made to individuals when there is no authorized dealer in the immediate area or when the complexity of the product selection necessitates the individual contacting Power By The Hour Performance directly. Power By The Hour will also sell direct to any customer with an authorized dealer in the customer’s immediate area if the customer chooses not to purchase from the authorized dealer. Power By The Hour reserves the right to sell to any retail customer.

SALES TO BUSINESSES

-JOBBER/INSTALLER:
Any shop engaged in retail sales or installation of automotive and truck related equipment can qualify as a jobber and installer. Please see the Requirements form for further qualification details.

-DEALER:
A dealer must be able to maintain a set level of annual sales with Power By The Hour Performance products. Jobber and Dealer levels are able to be adjusted at the discretion of Power By The Hour. Further information is available on the enclosed Dealer Requirements form. Possession of a dealer price list does not guarantee these prices, the dealer application must first be approved and processed. All PBH Performance authorized dealers are listed on www.pbhperformance.com through a dealer locator map.

-WHOLESALE DISTRIBUTOR:
A Wholesale Distributor must be able to maintain a representative stock of Power By The Hour Performance products or accessory items for distribution. A Wholesale Distributor must be able to maintain a set level of annual sales with Power By The Hour Performance products. Further information is available on the enclosed Dealer Requirements form.

-SALES CHANNELS:
PBH Performance products are available to be sold online through personal company websites by all authorized Jobber, Dealer, and Wholesale Distributors, providing all additional policies and terms have been met. Power By The Hour does not authorize the sale of any new, unused products through online auction websites. Dealer and Wholesale Distributors must list a set level of PBH Performance products on their personal company websites as part of the Dealer requirements.

-COPYRIGHTS:
All Power By The Hour Performance test and photos are copyrighted, but are available to authorized dealers for promotional use. PBH Performance provides high resolution images. Contact for details.

SHIPPING
Shipping is normally via United Parcel Service(UPS) and United States Parcel Service(USPS) when necessary. Using a customer’s shipper account, shipments can also be made, with customer-made arrangements, through UPS. Contact PBH for more information.

-FREIGHT:
All Shipments F.O.B. West Palm Beach, FL

-TERMS:
All orders are shipped either prepaid with credit card(Visa, Mastercard, Discover, Amex), Check, Money Order, ACH, and Paypal(approval needed).

-DROP SHIPMENTS:
Power By The Hour Performance does offer drop ship. Drop shipments are for approved Dealer and Wholesale Distributor. All Dealer requirements must be met to continue this service. Power By The Hour Performance reserves the right to change this at its discretion at any time.
-DAMAGED SHIPMENTS AND MISSING ITEMS:
All shipments from Power By The Hour Performance are fully insured. Therefore, all claims for damaged must be made with the freight and shipping companies. Please contact PBH within 24 hours upon receipt of a damaged shipment for further details.

RETURNS
Merchandise may be returned if prior approval has been granted by PBH. All merchandise returned for credit must be done within 30 days of receipt, must be in perfect condition, and will be inspected upon arrival. The merchandise should be returned freight prepaid and insured. Returns are subject to a restocking fee between 10% and up to 30% based on inspection. PBH reserves the right to deny return of product based on inspection upon arrival.

All merchandise returned for warranty consideration, inspection, repair, etc must be sent freight prepaid and insured. All returns must include an RMA number, contact PBH to obtain this prior to shipping any items. Power By The Hour Performance will return all items covered under warranty freight prepaid and insured.

PRICING
All pricing is subject to change without notice. Price Lists are available from Power By The Hour Performance upon request. Power By The Hour strives to maintain the integrity of our pricing structure and strongly suggests that all of our merchandise be sold at or near suggested retail pricing. MAP(minimum advertised pricing) has been set 10% below retail pricing on all Power By The Hour Performance products. All plublic printed matter and/or online pricing is considered the advertised price. The dealer and its employees are responsible for MAP compliance.

JOBBER/DEALER/WHOLESALE DISTRIBUTOR REQUIREMENTS

Power By The Hour Performance products are available for resale through a multi-level discount program. Companies wishing to purchase at a discount must be directly involved in the resale of aftermarket automotive product and/or the customization of vehicles.

JOBBER
The Jobber/Installer program is offered as a courtesy to companies not wishing to “buy-in” or become stocking dealers. The Jobber/Installer program allows a 10% discount from retail pricing and will require the following:
Applicant company must send(mail or email) a copy of their resale and /or business license to Power By The Hour Performance to begin the application process.
Applicant must provide a photo of their business, along with the completion of paperwork provided by Power By The Hour Performance consisting of:

DEALER
The Dealer level will receive a 15% discount from retail pricing on most products. Businesses requesting the Dealer level must meet all of the basic Jobber/Installer requirements along with:
Applicant company must have an initial one-time “buy-in” order accumulating a minimum of $3500 at dealer pricing. This can be accomplished by purchasing $3500 worth of product or by purchasing whatever product is necessary, and “buying-in” with a $3500 payment to obtain the dealer level. All remaining credit will then go onto the customer’s account to be used toward future purchases as necessary.
To maintain the Dealer level, a minimum of $3500 must be purchased annually, with the “buy-in” completing the first year. This requirement is a cumulative total of all purchases over a 12 month rolling period. Dealers who do not meet the annual minimum will be required to either repeat the “buy-in” or purchase at the Jobber/Installer level.
The Dealer Level can also be obtained by cumulative Jobber/Installer purchases in the amount of $4500 annually, at the Jobber/Installer price level. All other Dealer requirements apply.

WHOLESALE DISTRIBUTOR
The wholesale distributor level will receive a 20% discount from retail. Businesses requesting the Wholesale Distributor level must meet all of the requirements of the Dealer program along with:
Applicant company must offer full product catalog of Power By The Hour Performance product through personal company websites and other e-commerce outlets.
To maintain the wholesale distributor level, a minimum of $7500 must be purchased annually. This requirement is a cumulative total of all purchases over a 12 month rolling period. Dealers who do not meet the annual minimum will be required to either repeat the “buy-in” or purchase at the Jobber/Installer level.
Applicant company must have an initial one-time “buy-in” order accumulating a minimum of $7500 at dealer pricing. This can be accomplished by purchasing $7500 worth of product or by purchasing whatever product is necessary, and “buying-in” with a $7500 payment to obtain the dealer level. All remaining credit will then go onto the customer’s account to b used toward future purchases as necessary.
When approved, wholesale distributors will purchase product with their 20% discount. Additional Discounts for quantity purchases will be outlined on select parts where an additional discount is available. Power By The Hour reserves the right to alter change this without notice. Approved WD’s will only receive this discount on select items from the Power By The Hour Performance Product lineup. These items will be marked on the Price List provided. Items outside of the WD Dealer program will be sold at the largest possible discount from lower tier pricing.
